1. Membership Overview
By clicking “Place Order,” entering payment details, or otherwise enrolling in the Tony’s Acoustic Challenge Membership (“Membership”), you (“Member”) agree to these Terms of Purchase with Acoustic Life, Inc. (“Company”).
1.1 Included Services
Your Membership includes the content and services listed on our website at the time of purchase, which may include:
- Daily Guitar Challenge (pre-recorded video lessons)
- Guitar Technique Skill Courses
- Access to the TAC community and member resources
- Fretboard Wizard Add-On (if purchased — see Section 1.3)
1.2 Access
Your Membership access remains active while your account is in good standing and payments are current. Access is personal to you and cannot be shared, sold, or transferred.
1.3 Fretboard Wizard Add-On (Access Condition)
If you purchase the Fretboard Wizard program (full price $419 or promotional price $147), you will have access to the program for as long as your TAC Membership remains active. If your TAC Membership is canceled, suspended, or expires for any reason, access to Fretboard Wizard will end at the same time. Fretboard Wizard is licensed for personal use and is not sold as a standalone or lifetime product.
2. Payment, Renewal, and Refund Policy
2.1 Membership Plans
We offer several plans:
- Monthly – renews every 30 days
- Quarterly – renews every 90 days
- Annual – renews every 365 days
- Lifetime – one-time payment, no renewal
- Initiation Fee Plans – From time to time, we may offer Memberships with a one-time initiation fee followed by a lower ongoing monthly rate. For example:
- $197 today, then $20/month starting 30 days after purchase
- $344 today, then $20/month starting 30 days after purchase
Your initiation fee is charged immediately at checkout, is covered by the 60-day money-back guarantee for first-time purchases, and is non-refundable after the 60-day period. Monthly billing will continue automatically until you cancel.
2.2 Automatic Renewal Notice
Except for Lifetime plans, your Membership will automatically renew at the end of each term using your payment method on file, at the then-current rate, unless you cancel before the renewal date. Renewal confirmation emails will be sent to the address on file.
2.3 Introductory or Promotional Pricing
If your first term is discounted or promotional, your Membership will automatically renew at the standard rate unless stated otherwise at the time of purchase.
2.4 Refund Policy
- First-time purchase: Full refund within 60 days of your initial purchase date.
- Renewals: Non-refundable after the 60-day initial guarantee period.
- To request a refund, email support@tonypolecastro.com. Refunds are processed to the original payment method.
- Example for Initiation Fee Plans: If you choose the $344 today + $20/month option and request a refund within 60 days of purchase, you would receive a refund of the $344 initiation fee plus any $20 monthly charge(s) made during that 60-day period. In most cases, this totals $364 or $384 depending on the timing of your request. After 60 days, no refunds are available.
2.5 Plan Changes
You may request to switch between available plans; changes take effect at your next billing date unless otherwise stated.
2.6 Failed Payments
If payment fails, access may be paused until a valid payment method is provided.
3. Cancellation Policy
You may cancel at any time by:
- Logging into your account, selecting “My Account,” and clicking “Cancel,” or
- Emailing support@tonypolecastro.com with your request.
Upon cancellation, you will keep access through the end of your paid term. No partial refunds are issued after the 60-day guarantee period.
If you purchased the Fretboard Wizard Add-On, your access to Fretboard Wizard will also end when your TAC Membership ends.
4. Disclaimer
Your results will vary based on your participation, effort, and personal circumstances. The Company makes no guarantees of specific skill improvements or outcomes. All content is provided “as is” without warranties of any kind.
We are not medical, psychological, or financial professionals, and our services do not replace professional advice in those areas.
5. Intellectual Property Rights
All TAC content, including videos, lessons, documents, and community resources, is owned by the Company and protected by copyright and other intellectual property laws.
You may not reproduce, share, sell, or distribute any content without our prior written permission.
6. Limitation of Liability
To the fullest extent allowed by law, the Company will not be liable for any direct, indirect, incidental, or consequential damages arising from your Membership use.
7. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Montana. Disputes will first be addressed through good-faith negotiation. If unresolved, disputes will be submitted to binding arbitration through the American Arbitration Association, held in Helena, MT, or by phone/video conference.
